Introduction

Welcome to Swift (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our ride-hailing services (the “Services”). By using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use our Services.

1. Definitions

  • User: Any individual who registers for and/or uses our Services, including both riders and drivers.
  • Rider: A user who requests and/or receives transportation services through our platform.
  • Driver: A user who provides transportation services to riders through our platform.

2. User Accounts

A. Registration

To use our Services, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

B. Eligibility

You must be at least 18 years old to register for and use our Services. By registering, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

3. Use of Services

A. Rider Responsibilities

Riders agree to:

  • Provide accurate information when requesting a ride.
  • Be available at the designated pickup location at the specified time.
  • Pay all fees associated with the ride, including any cancellation fees as described below.

B. Driver Responsibilities

Drivers agree to:

  • Provide transportation services in a safe, professional, and lawful manner.
  • Maintain all necessary licenses, insurance, and vehicle inspections required by law.
  • Keep their account information and vehicle details up to date.

4. Fees and Payment

A. Ride Fees

Riders are responsible for paying the fare for each ride, as calculated by our app based on distance, time, and any applicable surcharges.

B. Upfront Pricing

We provide upfront pricing for rides based on the estimated distance and time. However, if the ride is significantly longer than expected due to traffic, route changes, or other unforeseen circumstances, a new price will be calculated and charged accordingly.

C. Cancellation Fee

A £5.20 cancellation fee will be charged to riders in the following circumstances:

  • If a ride is cancelled within 1 hour of the booked time.
  • If a ride booked for immediate pickup is cancelled outside 2 minutes of the booking confirmation.

The cancellation fee is non-refundable and will be automatically charged to the rider’s payment method on file.

5. Cancellations and Refunds

A. Rider Cancellations

Riders may cancel a ride request at any time; however, the cancellation fee will apply if the cancellation occurs within the specified time frames as outlined above.

B. Driver Cancellations

Drivers may cancel a ride if the rider is not at the designated pickup location within a reasonable time or if they feel unsafe. In such cases, the rider may still be charged a cancellation fee.

C. Refunds

Refunds will be issued at our discretion and only in exceptional circumstances. To request a refund, riders must contact our customer support team within 7 days of the ride in question.

6. Safety and Conduct

A. Rider Conduct

Riders must:

  • Wear seat belts at all times during the ride.
  • Refrain from any illegal, abusive, or disruptive behavior.
  • Respect the driver and the driver’s vehicle.

B. Driver Conduct

Drivers must:

  • Drive safely and follow all traffic laws.
  • Maintain a clean and well-kept vehicle.
  • Refrain from any illegal, abusive, or disruptive behavior.

7. Limitation of Liability

We are not liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our Services. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Swift, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our Services, your violation of these Terms, or your violation of any rights of another.

9. Changes to Terms

We may modify these Terms at any time. We will notify you of any significant changes by posting the new Terms on our app and website or by other means of communication. Your continued use of our Services after the effective date of the revised Terms constitutes your acceptance of the changes.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of United Kingdom, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in [Jurisdiction] to resolve any dispute arising out of or relating to these Terms or your use of our Services.
